International patent applications may be filed within 1 year after your first application on the invention, if desired. Some countries do not allow the 1-year delay, and you must file in those countries before any public disclosure if you need patent protection in these countries. Many countries have signed the PCT, which allows up to 30 months from the priority date to file applications in signatory countries. What events can happen in the registration process?

Granting : When a patent application meets all the requirements, the Patent  Office registers it.
Office action: If the Patent Office does not have the correct information or lacks documents in the application to proceed with the process, it makes a request for information. The applicant needs to respond to this request.

Opposition: If the application complies with all formal requirements, the Patent Office makes it public. This gives an opportunity to anyone who believes that the new patent violates any of their rights to file an opposition. The applicant must respond showing that the opposition has no basis, and the registration process must continue.

Refusal: The Patent Office issues a resolution explaining the legal reasons why the application was denied.

Reconsideration and appeal: The Patent Office may grant or deny registration of a new patent. In either case, the dissatisfied party can file a reconsideration or an appeal in order to change the decision. There will be no certainty of patent applications if unresolved resources are pending.

Companies should establish procedures to ensure that all product development is referred to a senior official within the company. A useful way of doing so is to make an invention disclosure form available to employees and to ensure that any potential inventions within an offering are considered for patentability prior to release.

Innovation and Confidentiality

Controls must be in place to ensure that any innovation is maintained confidential until an application has been filed. Employees should be made aware not to disclose or misuse innovation. There should be a sense of awareness among employees, and innovation should be restricted on a “need to know” basis. Companies should take care in releasing details

of innovation outside of the company. The company should keep detailed records of the development of new products or technology.
